The HRMO told the mayor that he cannot appoint an administrator unless the vacant few head positions will be filled.Is this correct?

Appointments are generally discretionary on the part of the appointing authority. Thus, when a vacancy occurs, the head of agency may issue an appointment in favor of one who meets the required qualification standards for the position. Provided, further, that the appointee has gone thru the procedural requirements provided by civil service laws, rules, and regulations.

Thus, when there is a vacancy in the position, e.g. city or municipal administrator position, the head of agency may issue an order for the constitution of an HRMPSB, unless one has already been constituted, for the screening of candidates for the said position.
