Good morning...

I am Apolinario Mabini (not my real name) from Nueva Ecija.

Last May 2016 I applied for teaching position in Senior High School in our Division Office and lucky on June 2016 I was appointed as Teacher 2 in provisional status for reason that I am not yet a LET (Licensure Examination for Teachers) passer.

On March 2017, I applied for the LET Examination and the result was released on May 2017 and I PASSED the exam.

When I submitted my documents (LET Exam result) at our Division Office hoping that my appointment status will now be PERMANENT, I was surprised that I was instead reappointed as Teacher 1 without any notice/information whatsoever given to me to that effect.

As of now, I am still Teacher 1 and I am writing this query to seek guidance and enlightenment from regarding this matter, if this is JUST and LEGAL.

Please be informed that as a policy, the Commission does not render opinions or rulings on issues that may eventually be the subject of court litigation or appeal before it. This is especially so if the material facts necessary to a judicious adjudication of the issues are not fully presented or substantiated as in this case.

Nonetheless, we would like to invite your attention to Section 10 (a) and (b), Rule IV, 2017 Omnibus Rules on Appointments and Other Human Resource Actions which provides, as follows:

"Sec. 10. Employment Status of Teachers. The employment status of teachers to any teaching position shall be any of the following:

a. Permanent - an appointment issued to an appointee who meets all the requirements of the position.

"b. Provisional - an appointment issued to an appointee who meets all the requirements of the position except the eligibility but only in the absence of a qualified eligible actually available who is willing to accept the appointment, as certified by the Schools Division Superintendent. It shall not be effective beyond the school year during which it was issued. The appointment may be subject to reappointment (renewal)."
