Do you conduct audit or investigation to an agency to confirm whether they follow or not the CSC rules about nepotism?
What is the proper or legal way to report a particular agency who is violating this rule?
Is it the CSC or the Ombudsman the proper authority who handles this issue?

You query pertains to administrative offense of nepotism.

The CSC has its means to check the existence of nepotism particularly in the Item No. 36 of Personal Data Sheet (PDS) which appointees submit in support of their applications and in turn, submitted by the agencies in support of the appointment submitted for approval of the CSC Field Offices; and employees are also regularly required to submit Updated PDS to their agency/ies.

In the said item in the PDS it is asked:

“Are you related by consanguinity or affinity to the appointing or recommending authority, or to the chief of bureau or office or to
the person who has immediate supervision over you in the Office, Bureau or Department where you will be appointed,

a. within third degree?
b. fourth degree (for Local Government Unit – Career Employees)?”

The Personal Data Sheet is under oath, hence, it is imperative that the facts stated therein are truthful.

Should there be any report of Nepotism, the CSC may conduct an investigation provided that the requirements for filing of administrative complaint as provided for under the 2017 Rules on Administrative Cases in the Civil Service are complied with.

Please do note that the following are exempted from the operation of the rules on nepotism:
a. persons employed in a confidential capacity;
b. teachers;
c. physicians;
d. members of the Armed Forces of the Philippines.

In our agency, our HR Manager hired his wife and currently stationed in our district office while their daughter is also an employee within our agency. (I just do not know if their daughter is hired in a confidential capacity). If the Item No. 36 in the PDS is your only tool to determine those agencies who violates the rule on nepotism, then how come that in our agency that they are continually doing these? Actually, there are lots of employees in our agency who are related to each other: for example, mag-ama, mag asawa (hindi po sila sa opisina nagkakilala at pagkatapos ay ikinasal, they just hire the spouse due to whatever reasons they have) mag pinsang buo, etc... There is no way in the item 36 of the PDS that you can see this, because if you do, they will not be in our office...
